Judicial independence and integrity safeguards

Review of judicial independence and integrity safeguards established in legislation and regulations. National authorities are asked to provide reference to provisions that meet the criteria below. This is validated by the OECD. The criteria below are based on the Montreal Universal Declaration on the Independence of Justice (First World Conference on the Independence of Justice, 1983), the Basic Principles on the Independence of the Judiciary (adopted by the seventh United Nations Congress on the Prevention of Crime and the Treatment of Offenders held in Milan from 26 August to 6 September 1985 and endorsed by General Assembly resolutions Nos. 40/32 of 29 November 1985 and 40/146 of 13 December 1985), the Recommendation (94) 12 of the Committee of Ministers to Member States on the Independence, Efficiency and Role of Judges (adopted by the Council of Europe’s Committee of Ministers on 13 October 1994), the 2010 CCJE Magna Carta for Judges, the 1999 Universal Charter of the Judge, and the 2002 Bangalore Principles about Judicial Conduct.
